Fencing

If you plan to construct, repair or replace a fence, there are several things you will need to consider. The information below provides guidance on fencing requirements and fencing dispute resolution.

Building Requirements

The Building Act 1993 and Building Regulations 2018 outline the requirements for the construction of fencing on a property. Additional restrictions are also in place in some areas in the municipality under the Latrobe Planning Scheme. Covenants or agreements may also be registered on the title of your property and these should be reviewed for specific requirements on fencing in certain development areas.

Contacting Neighbours

Boundary fences between your property and properties adjoining yours are governed under the Fencing Act. Use the notice to fence form to inform your neighbours of the changes and request they contribute to the cost.

Unless Council is the adjoining owner, we do not have authority over, or any involvement with, arranging to replace or build this type of fence when a building or planning permit is not required.

Fencing Disputes

Fencing disputes may occur when your neighbour does not agree on how to replace, repair, or pay for a boundary fence. Disputes may also occur when the boundary fence has been modified without consent from both owners prior to the modifications being constructed. Due to the fence being constructed between two privately owned properties, the issue is a civil matter and must be resolved between the property owners, without Council involvement.
