Contact Council before you build or renovate

Latrobe City Council is reminding home-owners and builders to engage a private building surveyor to gain the necessary building permits and ensure they do not undertake illegal construction works.

Council has successfully pursued legal action against a property-owner in relation to breaches of the Building Act 1993.

Charges were brought as a result of the property-owner failing to obtain a building permit and failing to comply with a building order in relation to the extensive construction of a dwelling extension and alterations.

The property-owner undertook these works without first obtaining a building permit.

Council issued a building order to stop work until the matter was resolved by bringing the extension and alterations into satisfactory compliance with the Building Regulations.

The property-owner failed to comply with that order as the work on the extension and alterations continued during the enforcement process.

The property-owner was found guilty on both charges and incurred fines and costs of $26,500, including a criminal conviction for failure to comply.

“Council officers have the responsibility to ensure home renovators comply with the Building Act to ensure that buildings meet minimum safety standards. This reassures the current and future owners of a home that any works have been done properly and safely,” Latrobe City Council Mayor, Cr Sharon Gibson said.

Building surveyors issue building permits, and are tasked with protecting building occupants and owners by ensuring that a project complies with minimum building and safety standards.

“This case is a reminder that before any home-owner, building developer or handyman decides to initiate building works, they should check with Council or a private building surveyor to confirm if a building permit is required,” Cr Gibson said.

“While some may feel that this could be seen as Council playing ‘Big Brother’, Council has a role to play in ensuring the community’s safety.”
